According to a report by CBS13, MRRA Director Steve Levesque confi rmed that the company, which was one of the fi rst tenants at Brunswick Landing, failed to meet its fi nancial obligations. As early as 2013 Kestrel was behind on paying its rent and vendors and also had to cut health, life and dental insurance after it failed to pay premi- ums for its employees, CBS13 reported. It was unclear how the eviction would impact as many as 40 employ- ees of Kestrel's Brunswick facility. When it fi rst arrived at Brunswick Landing in 2011, Kestrel touted its potential to add 600 jobs there by 2016. But by early 2012 its plans shifted to Wisconsin, which had promised various fi nancial incentives if Kestrel located its manufacturing facility there. Kestrel did so, but contin- ued to maintain a small operation at Brunswick Landing. In 2015, Kestrel merged with Albuquerque, N.M.- based Eclipse Aerospace, becoming ONE Aviation. L.L.Bean sued over its 'Outsider' campaign L.L.Bean's new "Be An Outsider" branding campaign faces a legal challenge from a Salt Lake City clothing company claiming it's owned trademark rights for " e Outsider" since June 2015. KÜHL, a privately held outdoor apparel company with $200 million in sales in the United States, fi led a lawsuit against L.L. Bean in the U.S. District Court for the District of Utah Central Division alleging trademark infringement. e complaint was brought by a plaintiff listed as Alfwear, KÜHL's name when it was founded in 1983. e lawsuit asks the federal court to order L.L.Bean to halt its "Be An Outsider" campaign and award Alfwear "all damages it sustained as a result of Bean's acts of infringement or unfair competition, said amounts to be tripled, together with prejudg- ment interest" as well as "all profi ts received by Bean from sales or rev- enues of any kind made as a result of Bean's infringing actions, said amount to be tripled." L.L.Bean spokes- woman Carolyn Beam declined to comment to Bangor Daily News, stating the the company doesn't comment on pending litigation. "However, we fi rmly believe we are well within our legal rights to use the call to action 'Be An Outsider,' and look forward to resolving this issue," she told the newspaper. e Salt Lake City company noted that L.L.Bean applied for "Be An Outsider' with the U.S. Patent and Trademark Offi ce on June 30, 2017, for a "service mark for retail store services and retail services in computerized online retail store and mail order catalog services."
